No.

For your ISP, fetchmail is a mail-client just like thunderbird,
evolution or (shudder) outlook.

The thing that makes fetchmail different is that it stores mail not
"within the application", but "within the system".
If your system happens to use an IMAP-server for mail-storage, that is
something that a) no ISP can detect and b) no ISP can forbid you.

Fetchmail is purely on the receiving side of the e-mail business.

Spammers are located on the "sending side" of the e-mail business. This
is where SMTP-servers come into play. Basically a spammer needs to find
an SMTP-server which does not check who sends mail. These are either
"open relays" (=badly configured mail-servers on the internet) or they
do their work on virus-infected home-PCs (botnets).

You cannot send mail through IMAP, so this is not a concern here.
